President Obama’s nomination of Judge Sonia Sotomayor is a declaration of war against America’s gun owners and the Second Amendment to our Constitution. If gun owners mobilize and unite, it’s possible (though unlikely) to stop this radical nominee.
According to Judge Sotomayor, if your state or city bans all guns the way Washington, D.C. did, that’s okay under the Constitution.
Last year the Supreme Court handed down the landmark decision in D.C. v. Heller, holding that the Second Amendment right to bear arms applies to individual citizens in their private lives. The ruling marked a turning point in gun rights in this country.
In the past year, the biggest question courts now face is whether the Second Amendment applies to the states. That may sound crazy, but the reality is that the Bill of Rights only controls the federal government, it doesn’t apply directly to states or cities. Only the parts of the Bill of Rights that are “incorporated” through the Fourteenth Amendment apply to the states.
Since the Heller decision, only two federal appeals courts have written on the Second Amendment. That’s six judges out of about 170. Of those six, three said the Second Amendment does apply to the states. And those judges were out of the liberal Ninth Circuit in California, and included a judge appointed by Bill Clinton and another appointed by Jimmy Carter. — Even leftist judges can get this.
But not Judge Sonia Sotomayor. She is one of only three federal appellate judges in America to issue a court opinion saying that the Second Amendment does not apply to states. The case was Maloney v. Cuomo, and it came down this past January.
That means if Chicago, or even the state of Illinois or New York, wants to ban you from owning any guns at all, even in your own house, that’s okay with her. According to Judge Sotomayor, if your state or city bans all guns the way Washington, D.C. did, that’s okay under the Constitution.
This issue could not be more important. Today, on the very day President Obama has announced Judge Sotomayor’s nomination, the National Rifle Association is arguing Second Amendment incorporation in court before the Seventh Circuit in a case challenging the Chicago ban on handguns.
If this case, or one like it, goes to the Supreme Court, Justice Sotomayor would say that Chicago can ban all your guns. If she can persuade her liberal colleagues on the Court to join her, it could become the law of the land that states and cities can ban guns. Should that happen, then you can expect anti-gun liberals in state legislatures to rush to pass new state laws doing exactly that.
The White House is telling us all about Judge Sotomayor’s compelling personal story — and it is an amazing story of what is possible “only in America.” But compelling personal stories are not the question. Miguel Estrada, whom President George W. Bush nominated to the D.C. Circuit appeals court and was planning on nominating to the Supreme Court, had a compelling story as a Hispanic immigrant who legally came to this country not even speaking English. Democrats filibustered Mr. Estrada.
Supporters point out that Judge Sotomayor was first appointed by George H.W. Bush for the federal trial court — before Bill Clinton elevated her to the Second Circuit appeals court. That’s true, but George H.W. Bush also gave us Justice David Souter, so clearly he wasn’t too careful about putting liberals on the federal bench. We can’t allow the left to hide behind the Bushes.
But when it comes to gun rights, we don’t need to guess. Judge Sotomayor has put in writing what she thinks. President Obama has nominated a radically anti-Second Amendment judge to be our newest Supreme Court justice.
There are a number of pro-Second Amendment Democratic senators from deeply red states, including Mark Begich from Alaska, Jon Tester and Max Baucus from Montana, Ben Nelson from Nebraska, Byron Dorgan and Kent Conrad from North Dakota, and Tim Johnson from South Dakota.
These senators will jeopardize their seats if they vote to support an anti-gun radical for the Supreme Court. Second Amendment supporters will now be up in arms over this radical anti-Second Amendment nominee, and you should never underestimate the political power of American gun owners.

Better Money Than the Dollar?
Communities Print Own Currencies to Keep Money Local

GREAT BARRINGTON, Mass. — It looks like Monopoly money, but the colorful currency created by collaborators in the western Massachusetts town of Great Barrington is legal tender.
The creative cash is called "BerkShares," a play on words, referring to the mountainous region called the Berkshires, where businesses and citizens have come together to support each other in these tough economic times.
Asa Hardcastle, the president of BerkShares Inc., says the unique bills can be picked up at local banks. For every 95 cents, consumers get a dollar's worth of BerkShares, which can be used to purchase goods and services at participating local shops. So far, 400 businesses have signed up.
"Local currency helps to keep the money flowing between friends and neighbors, local businesses, which helps everybody to have a better life," Hardcastle said, sipping on a cup of joe bought with BerkShares.
They're not alone. From Detroit to North Carolina to upstate New York, at least a dozen communities are trying to encourage people to buy locally, creating their own currencies.
In the Berkshires, the bills are printed on the same paper as U.S. currency and by the same company — Crane & Co., based in the Berkshires town of Dalton, Mass. They feature local artists, heroes and historical figures and come complete with individual serial numbers, making them a tough target for counterfeiters. The program is made possible through private grant funding.
Roughly 2.3 million minted BerkShares have circulated through the community since the program's launch in 2006.
Matt Rubiner, owner of Rubiner's Cheesemongers & Grocers, stands behind the local currency.
"Philosophically, it's very much along the lines of the foundations that we set up our store under. Supporting local, sustainable producers. Keeping the community local wherever possible and so, when the BerkShares came along, that was right up our alley. We really embraced it," Rubiner said.
His shop takes special effort to buy local products and support local dairy farmers.
"We begin to feel we can take care of ourselves maybe a little bit better," he said "Maybe it does bind us a little more closely."
Customer Heather Fisch stopped by Rubiner's to try a slice-of-the-day, saying she's a big supporter of BerkShares.
"I think it's nice to have a constant little reminder that we're a community and we're in it together," Fisch said. "It's kind of like a Great Barrington pride moment. I'm a citizen of Great Barrington. Here's my BerkShare."
Historically, it's not a new phenomenon. Local communities printed their own currency during past recessions, as recently as the 1980s. During the 1860s, local banks printed money. New England's mills often paid their employees in scrip, a system of payment that could only be used at a company store or in the local town.
Robert Bench, a senior fellow at Boston University and former National Bank supervisor, says local currency efforts have proved successful in the past, helping to encourage consumers spend close to home.
"I think it brings out the community spirit that's in everybody's self conscience," he said.

I am honored to represent the Constitution Party of Missouri today. I am a founding member of the party and I serve as State Secretary. I also was privileged to represent the Constitution Party as their 3rd Congressional District candidate for Congress in 2008.
I would like to mention a few things that distinguishes the Constitution Party from other parties. One, you will find our members greatest loyalty is to the Constitution rather than the party, and secondly, unique to our party is the fact that all thirty-nine planks of our platform are linked to an authorizing statement in the Constitution, the Bill of Rights or the Declaration confirming that our positions are constitutional. But perhaps the best way to clearly and quickly define our party is to share our mission statement with you.
The goal of the Constitution Party of Missouri is to promote and defend the great American principles of individual liberty and the return to constitutional government by means of educational and political activity, and through the election, at all levels of government, of Constitution Party candidates, who will uphold the principles of the Declaration of Independence and the Constitution of the United States.
Promoting and defending the principles of individual liberty and returning to constitutional government is the driving force behind everything we do in the Constitution Party of Missouri. We are here today because this rally is centered around the 9th and 10th amendments to the Constitution - amendments, which embody the principle of state sovereignty. This principle of state sovereignty is rooted in the historical fact that the states created the national government and gave it few and defined powers, and those powers are clearly enumerated in Article 1, Sec 8 of the Constitution. That’s it, nineteen delegated powers from the states to the federal government. Anything else the national government does to interfere or intervene in state government is a direct violation of the Constitution.
Our party platform includes a plank on state sovereignty, and the sixth principle of the seven principle of the Constitution Party is State Sovereignty. I would like to read part of that plank to you.
The 10th Amendment states: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”
The Constitution delegated few, enumerated powers to the Federal Government, reserving all remaining powers to the States and the people. Thus, powers of the Federal were the exception.
Our federal republic was created by joint action of the several states. It has been gradually perverted into a socialist machine for federal control in the domestic affairs of the states.
The federal government has no authority to mandate policies relating to state education, natural resources, transportation, private business, housing, and health care, ad infinitum.
We call upon the states to reclaim their legitimate role in federal affairs and legislation (See Amendment 10 United States Constitution) and thus cause the federal government to divest itself of operations not authorized by the Constitution and extract the federal government from such enterprises, whether or not they compete with private enterprise. The Constitution Party believes that state sovereignty is an important step in restoring the proper balance between state and federal governments.
I wish restoring proper roles of government was as simple as quoting amendments and party platform planks. However, we all know that it requires more than words to affect the necessary changes. Yet, if we expect to survive as a nation, we must return to the place, where the Constitution is honored once again by our elected officials as the supreme law of the land.
“How will that happen? What will it take?” Is a question that has been on my mind and heart for years and I’m sure on the hearts of many here today. And for the first time in years I am filled with hope that we may actually be seeing an answer to the questions. In fact, there is a part in the Declaration of Independence that eludes to the very nature of what I see happening,
Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn that mankind are more disposed to suffer, while evils are sufferable than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security. — Such has been the patient sufferance of these Colonies; and such is now the necessity which constrains them to alter their former Systems of Government. The history of the present King of Great Britain is a history of repeated injuries and usurpations, all having in direct object the establishment of an absolute Tyranny over these States.
This is the place we find ourselves today. We have had a history of repeated injuries and usurpations and the shenanigans of Wall Street bankers, the Federal Reserve, Congress and both Presidents Obama and Bush have heaped insult upon injury. Their outrageous behavior has brought thousands of people together in a way that no one could have planned.
Protests, tea parties and meet-up groups are gathering all across the nation, and when you made the decision to be here today, you also became part of this movement to reign in a rogue government.
And lest you think I am unduly harsh in using such a word to describe our government, let me define “rogue” for you. The dictionary defines rogue as “a dishonest and unprincipled person” and a second definition further states a rogue is “a person or thing that is defective or unpredictable. I have no trouble applying all of those adjectives to our government, for it has truly acted in a dishonest, unprincipled manner and has become defective and unpredictable in it’s efforts to solve the very problems it created at the expense of the taxpayers.
Furthermore, we know that rogues do not, without an outside force acting upon them, change their ways. That is what you have become today, an outside force being applied, when you say to your state legislator, “You know, I believe the Constitution of the United States limits the authority of the federal government, and I want you, my state government to get off the federal welfare rolls, and start acting as a sovereign state that does not exist by the good graces of Washington.”
And let me repeat, this is just a start. You cannot leave here today, thinking, “Well, I’ve done my duty! No, that won’t cut it.” This is just the beginning of a long, hard fight. Can you imagine where we would be today if the signers of the Declaration would have just signed and went home to take their ease?
The signers of the Declaration of Independence pledged their lives, their fortunes and their sacred honor. If you think you can do any less, then you are not cut out for the battle. Yes, this battle is not to the faint of heart, but to those, as one of my favorite lines from the song America the Beautiful states, those “who more than self their country loved”. Battles are won by those who have that level of commitment.
What is your commitment level?
Will you commit to educating yourself in the ideas of liberty and the principles of constitutional government?
Will you then use that knowledge to hold your elected officials accountable to oath of office?
Will you be willing to replace those who violate the Constitution?
Will you be willing to even run for office yourself to assure a choice for candidates, who will obey the Constitution?
The Constitution Party is committed to restoring constitutional government that guarantees individual liberty to all. We are committed to make the necessary sacrifices to insure that our posterity will enjoy the blessing of liberty. We invite you to join us in this worthy and honorable cause.

Oath Keepers

The organization describes itself as a non-partisan group of members
of the military as well as peace officers "who will fulfill our oath
to support and defend the Constitution against all enemies, foreign
and domestic, so help us God."
Among the orders the soldiers are pledging NOT to obey:
1. We will NOT obey any order to disarm the American people. Any
such order today would also be an act of war against the American
people, and thus an act of treason. We will not make war on our
own people, and we will not commit treason by obeying any such
treasonous order.
2. We will NOT obey any order to conduct warrantless searches
of the American people, their homes, vehicles, papers, or effects
- such as warrantless house-to house searches for weapons or
persons. We expect that warrantless searches of homes and vehicles,
under some pretext, will be the means used to attempt to disarm the
people.
3. We will NOT obey any order to detain American citizens as
"unlawful enemy combatants" or to subject them to trial by military
tribunal. Any attempt to apply the laws of war to American civilians,
under any pretext, such as against domestic "militia" groups the
government brands "domestic terrorists," is an act of war and an act
of treason.
4. We will NOT obey orders to impose martial law or a "state of
emergency" on a state, or to enter with force into a state, without
the express consent and invitation of that state's legislature and
governor. It is the militia of a state and of the several states that
the Constitution contemplates being used in any context, during any
emergency within a state, not the standing army.
5. We will NOT obey orders to invade and subjugate any state that
asserts its sovereignty and declares the national government to be in
violation of the compact by which that state entered the Union.
6. We will NOT obey any order to blockade American cities, thus
turning them into giant concentration camps. Such tactics by the
Nazis in the Warsaw Ghetto, and by the Imperial Japanese in Nan
King, turn[ed] entire cities into death camps. Any such order to
disarm and confine the people of an American city will be an act
of war and thus an act of treason.
7. We will NOT obey any order to force American citizens into any
form of detention camps under any pretext. . Such a vile order to
forcibly intern Americans without charges or trial would be an act
of war against the American people, and thus an act of treason,
regardless of the pretext used.
8. We will NOT obey orders to assist or support the use of any
foreign troops on U.S. soil against the American people to
"keep the peace" or to "maintain control" during any emergency, or
under any other pretext. We will consider such use of foreign troops
against our people to be an invasion and an act of war.
9. We will NOT obey any orders to confiscate the property of the
American people, including food and other essential supplies, under
any emergency pretext whatsoever.
10. We will NOT obey any orders which infringe on the right of the
people to free speech, to peaceably assemble, and to petition their
government for a redress of grievances.
"We will not make war against our own people. We will not commit
treason. We will defend the Republic," "And for the support of this
Declaration, with a firm reliance on the protection of Divine
Providence, we mutually affirm our oath and pledge to each other
our Lives, our Fortunes, and our sacred Honor."

to support and defend the Constitution against all enemies, foreign
and domestic, so help us God."
Among the orders the soldiers are pledging NOT to obey:
1. We will NOT obey any order to disarm the American people. Any
such order today would also be an act of war against the American
people, and thus an act of treason. We will not make war on our
own people, and we will not commit treason by obeying any such
treasonous order.
2. We will NOT obey any order to conduct warrantless searches
of the American people, their homes, vehicles, papers, or effects
- such as warrantless house-to house searches for weapons or
persons. We expect that warrantless searches of homes and vehicles,
under some pretext, will be the means used to attempt to disarm the
people.
3. We will NOT obey any order to detain American citizens as
"unlawful enemy combatants" or to subject them to trial by military
tribunal. Any attempt to apply the laws of war to American civilians,
under any pretext, such as against domestic "militia" groups the
government brands "domestic terrorists," is an act of war and an act
of treason.
4. We will NOT obey orders to impose martial law or a "state of
emergency" on a state, or to enter with force into a state, without
the express consent and invitation of that state's legislature and
governor. It is the militia of a state and of the several states that
the Constitution contemplates being used in any context, during any
emergency within a state, not the standing army.
5. We will NOT obey orders to invade and subjugate any state that
asserts its sovereignty and declares the national government to be in
violation of the compact by which that state entered the Union.
6. We will NOT obey any order to blockade American cities, thus
turning them into giant concentration camps. Such tactics by the
Nazis in the Warsaw Ghetto, and by the Imperial Japanese in Nan
King, turn[ed] entire cities into death camps. Any such order to
disarm and confine the people of an American city will be an act
of war and thus an act of treason.
7. We will NOT obey any order to force American citizens into any
form of detention camps under any pretext. . Such a vile order to
forcibly intern Americans without charges or trial would be an act
of war against the American people, and thus an act of treason,
regardless of the pretext used.
8. We will NOT obey orders to assist or support the use of any
foreign troops on U.S. soil against the American people to
"keep the peace" or to "maintain control" during any emergency, or
under any other pretext. We will consider such use of foreign troops
against our people to be an invasion and an act of war.
9. We will NOT obey any orders to confiscate the property of the
American people, including food and other essential supplies, under
any emergency pretext whatsoever.
10. We will NOT obey any orders which infringe on the right of the
people to free speech, to peaceably assemble, and to petition their
government for a redress of grievances.
"We will not make war against our own people. We will not commit
treason. We will defend the Republic," "And for the support of this
Declaration, with a firm reliance on the protection of Divine
Providence, we mutually affirm our oath and pledge to each other
our Lives, our Fortunes, and our sacred Honor."
